    These Terms of Service govern your use of MailFred's cold email automation services. Please read them carefully.

    These Terms of Service ("Terms") govern your access to and use of the services provided by Modern Business Workers V.O.F., a Dutch company operating under the trade name "MailFred" ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

    1. Acceptance of Terms

    By using MailFred's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

    2. Description of Services

    MailFred provides automated cold email outreach services, including but not limited to:

    • • Email personalization and campaign creation
    • • Email infrastructure setup and management
    • • Campaign monitoring and analytics
    • • Inbox management and response handling

    3. User Responsibilities

    3.1. Compliance with Laws

    You agree to use our services in compliance with all applicable laws, regulations, and industry standards, including but not limited to GDPR, CAN-SPAM Act, and other data protection and anti-spam legislation.

    3.2. Content and Data

    You are responsible for ensuring that all content, data, and instructions you provide to us are accurate, lawful, and do not infringe on the rights of third parties. You warrant that you have the necessary rights and permissions to use and share such content and data.

    3.3. Prohibited Uses

    You agree not to use our services for:

    • • Sending unsolicited emails to individuals who have not consented to receive such communications
    • • Promoting illegal activities, hate speech, or discriminatory content
    • • Attempting to gain unauthorized access to our systems or third-party systems
    • • Violating any applicable laws or regulations

    4. Payment Terms

    4.1. Fees

    Fees for our services are as specified in your service agreement or on our website. All fees are quoted in Euros (€) and are exclusive of applicable taxes unless otherwise stated.

    4.2. Payment Schedule

    Fees are payable monthly in advance unless otherwise agreed in writing. Payment is due within 14 days of the invoice date.

    4.3. Late Payments

    Late payments may result in suspension of services and may incur late fees as permitted by applicable law.

    5. Data Processing and Privacy

    Our processing of personal data is governed by our Privacy Policy and Data Processing Agreement (DPA), which are incorporated by reference into these Terms. We are committed to protecting your privacy and handling data in accordance with applicable data protection laws.

    6. Intellectual Property

    6.1. Our IP

    MailFred retains all rights, title, and interest in and to our services, software, technology, and any improvements or modifications thereof.

    6.2. Your IP

    You retain ownership of your content and data. You grant us a limited license to use your content and data solely for the purpose of providing our services to you.

    7. Service Availability and Support

    7.1. Service Levels

    While we strive to provide reliable services, we do not guarantee uninterrupted availability. We may perform maintenance that temporarily affects service availability.

    7.2. Support

    Support is provided via email during our business hours. We aim to respond to support requests within one business day.

    8. Limitation of Liability

    8.1. Disclaimer

    Our services are provided "as is" without any warranties, express or implied. We disclaim all warranties including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

    8.2. Limitation

    To the maximum extent permitted by law, our total liability to you for any claims arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

    8.3. Exclusions

    We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

    9. Termination

    9.1. Termination by You

    You may terminate your use of our services at any time by providing 30 days' written notice.

    9.2. Termination by Us

    We may terminate or suspend your access to our services immediately if you breach these Terms or for any other reason with 30 days' notice.

    9.3. Effect of Termination

    Upon termination, your right to use our services will cease immediately. We will return or delete your data as specified in our Data Processing Agreement.

    10. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or relating to these Terms shall be resolved in the courts of Amsterdam, the Netherlands.

    11. Changes to Terms

    We may update these Terms from time to time. We will notify you of any material changes by email or by posting a notice on our website. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
